NOTICE TO USERS: Use of LogoMaven constitutes your acceptance of the following terms. If you do not agree to the terms of this agreement, do not install and/or use this software. Your use of this software is conditioned upon compliance by you with the terms of this agreement.
For the purposes of this license agreement, 'SOFTWARE' means the program LogoMaven and includes the Evaluation and Full editions. 'YOU' means the company, entity, or individual installing or using the SOFTWARE, 'USE' means storing, loading, installing, executing, or displaying the SOFTWARE. “CONTENT” means the background designs, templates, themes, objects, shapes, embellishments, textures, Adobe® Flash® provided to YOU under either the Evaluation Agreement or the Full Agreement. “DESIGNS” is a sub-set of the CONTENT, which stands to include backgrounds, templates, textures & themes. “OBJECTS” is a sub-set of the CONTENT, which stands to include objects, shapes, embellishments & fonts.
AppMaven L.L.C. retains ownership and copyright and exclusively reserves all rights to the SOFTWARE. AppMaven L.L.C. asserts its right to be recognized as the author and owner of LogoMaven.
EVALUATION AGREEMENT: A free evaluation/trial edition of LogoMaven is available. The evaluation edition of the program is fully functional with a few limitations: (1) Printing & Exporting is disabled. (2) Limited number of Templates & Objects are available. Once you purchase the program, you will receive a License Key that will convert the evaluation edition of the program with Printing and exporting re-enabled along with additional Templates and Objects.
FULL AGREEMENT: A paid version of LogoMaven is available. The Paid version of the program is fully functional without any limitations. A Paid version license is valid as long as you maintain your license/subscription.
LICENSE GRANT: AppMaven L.L.C. grants you a license to use one copy of the SOFTWARE on a single computer for use by a single individual unless multiple licenses or a site license has been purchased in which case the SOFTWARE may be used by multiple individuals on multiple computers within a single institution at a single physical location. This license is not transferable to any other hardware product or other company, entity, or individual. The license to use the SOFTWARE and the included or downloaded CONTENT is valid, as long as your subscription is valid. You may not use any CONTENT beyond the License period.
OWNERSHIP: The SOFTWARE & CONTENT is owned and copyrighted by AppMaven L.L.C. in its native form. If you use the objects or templates in your designs, and enough modifications have been deemed to be made, you may proceed with the copyright. The SOFTWARE & CONTENT is licensed and not sold. YOU acquire only the right to use the SOFTWARE & CONTENT and do not acquire any rights, express or implied, in the SOFTWARE or CONTENT other than those specified in this License.
COPYRIGHT: The SOFTWARE is protected by United Stated copyright law and international treaty provisions. YOU acknowledge that no title to the intellectual property in the SOFTWARE is transferred to YOU. YOU further acknowledge that title and full ownership rights to the SOFTWARE will remain the exclusive property of AppMaven L.L.C. and you will not acquire any rights to the SOFTWARE except as expressly set forth in this license.
UNAUTHORIZED USE: YOU may not modify the SOFTWARE or disable any licensing or control features of the SOFTWARE except as an intended part of the SOFTWARE's programming features. YOU may not use, copy, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the SOFTWARE except as provided in this agreement. Nor can the materials produced with this SOFTWARE be, in any way or form, offered for resale. Any such unauthorized use shall result in immediate and automatic termination of this license.
BUNDLING: The SOFTWARE may not be bundled with hardware or other software without written permission from AppMaven L.L.C. Please contact the appropriate department for further information.
DISTRIBUTION: The Evaluation version may be freely distributed, with exceptions noted below, provided the distribution package is not modified. No person or company may charge a fee for the distribution of the SOFTWARE without written permission from AppMaven L.L.C.
LIMITED WARRANTY: This SOFTWARE is provided on an 'as is' basis. AppMaven L.L.C. disclaims all warranties relating to this SOFTWARE, whether expressed or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. SEVERABILITY: In the event of invalidity of any provision of this license, the parties agree that such invalidity shall not affect the validity of the remaining portions of this license.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES: In no event shall AppMaven L.L.C. be liable to YOU for any consequential, special, incidental, or indirect damages of any kind arising out of the Installation, Delivery, Performance, or use of the SOFTWARE, even if AppMaven L.L.C. has been advised of the possibility of such damages. In no event will AppMaven L.L.C.'s liability for any claim, whether in contract, tort, or any other theory of liability, exceed the license fee paid by YOU, if any. Any liability of the seller will be limited to refund the purchase price if any.
DO NOT INSTALL THE PRODUCT IF YOU DO NOT AGREE WITH THIS END USER LICENSE AGREEMENT. BY CONTINUING TO INSTALL THE SOFTWARE YOU AGREE TO THIS LICENSE AGREEMENT AND WILL ABIDE TO IT EVEN AFTER EVALUATION OR PAID SUBSCRIPTION HAS EXPIRED.
