END-USER LICENCE AGREEMENT FOR ESHASOFT SOFTWARE:

By installing or using this software product ('Software') or any media components ('Components') of the Software (including but not limited to, any icons, cursors, pointers, sound files, audio, music, graphic files, images, photographs, animations, video, or text incorporated into the Software Product) or other electronic content included with this agreement you ('End-User') accept the terms of this license with Eshasoft. If you do not agree to the terms of this agreement and you are also the original licensee of this product, promptly return the product together with all accompanying items to your dealer for a full refund. This is the entire agreement between the parties relating to this product and supersedes any purchase order, communication, advertising or representation concerning the product. No change or modification of this license will be valid unless it is expressly written and signed by Eshasoft.


LIMITED USE LICENSE:

When license fee is paid, Eshasoft and its suppliers grant you the right to use one (1) copy of the accompanying product for your personal or professional use only. This license and the restrictions in this agreement cover both the Software and the other electronic content of the accompanying product. Eshasoft or its suppliers reserve all rights not expressly granted. This License does not constitute a sale and does not authorize a sale of the Software or anything created thereby. You must treat the Software and associated materials and any elements thereof like any other copyrighted material (e.g., a book or musical recording). In the event you fail to comply with any of the terms or conditions of this license, your rights to use the Software will end, you shall stop using the Software, remove the Software and Components from your computer, and permanently erase all copies of the Software and any Components. You may be held legally responsible for any copyright infringement that is caused or encouraged by your failure to abide by the terms of this license.


YOU MAY:

Use the Software and its Components on a single computer or workstation.
Make one copy of the Software solely for back-up and archival purposes in machine readable-form, provided such copy must contain all of the original Software's proprietary notices and Components.


YOU MAY NOT:

Permit other individuals to use the Software or its Components except under the terms listed above.
Use the Software or cause the Software or its Components to be used on more than one computer at the same time.
Permit concurrent use of the Software or its Components under any other form technically possible.
Sublicense the Software.
Copy the Software or any of its Components except as provided in this Agreement.
Modify, translate, reverse engineer, de-compile, disassemble, alter, translate or adapt (except to the extent applicable laws specifically prohibit such restriction), or create derivative works based on the Software or its Components.
Separate any Components. The Software Product is licensed as a single product, and neither the software programs, Components or any update or upgrade comprising the · Software Product may be separated or used in any other software or by more than one user at a time.
Rent, lease, license or otherwise transfer this Software without the express written consent of Eshasoft, except that you may transfer the complete Software copy and accompanying materials on a permanent basis, provided that no copies are retained and the recipient agrees to the terms of this Agreement.
Publicly perform or publicly display this Software or any of its Components without the express written consent of Eshasoft.
Use or duplicate any of the content, including but not limited to, any icons, cursors, pointers, sound files, audio, music, graphic files, images, photographs, animation's, video, or text incorporated into the Software Product for any commercial purpose.


LIMITATION OF LIABILITY:

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL ESHASOFT OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU, OR TO ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, LOSS OF PROFITS OR REVENUES, LOSS OF SAVINGS, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT WILL ESHASOFT BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE AMOUNT ESHASOFT RECEIVED FROM YOU FOR A LICENSE TO THE SOFTWARE, EVEN IF ESHASOFT SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.


COPYRIGHT:

All title and copyrights, in and to the Software (including but not limited to, any icons, cursors, pointers, sound files, audio, music, graphic files, images, photographs, animation's, video, or text incorporated into the Software Product), the accompanying printed materials, and any copies of the Software are owned by Eshasoft or its suppliers. Copyright laws and international treaty provisions protect the Software. You may not use the name, logo, or trademark of Eshasoft or the Software without express written permission from Eshasoft.


WARNING:

International treaties protect this program. Unauthorized reproduction or distribution of this program, or any portion of it, may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under law.
