END-USER LICENSE AGREEMENT FOR AutoWipe PC software product(s) IMPORTANT PLEASE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT CAREFULLY BEFORE CONTINUING WITH THIS PROGRAM INSTALL: Wipe-My-PC.COM End-User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Wipe-My-PC.COM For the Wipe-My-PC.COM AutoWipe PC software product(s) identified above which may include associated software components, media, printed materials, and “online” or electronic documentation and updates to said product(s).
By installing, copying, or otherwise using the AutoWipe PC software product(s), you agree to be bound by the terms of this EULA. This license agreement represents the entire agreement concerning the program between you and Wipe-My-PC.COM, (referred to as “licenser”), and it supersedes any prior proposal, representation, or understanding between the parties. If you do not agree to the terms of this EULA, do not install or use the AutoWipe PC software product(s).
The AutoWipe PC software product(s) is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The AutoWipe PC software product(s) is licensed not sold.
1. GRANT OF LICENSE. The AutoWipe PC software product(s) is licensed as follows: (a) Installation and Use. Wipe-My-PC.COM grants you the right to install and use copies of the AutoWipe PC software product(s) on your computer running a validly licensed copy of the operating system for which the AutoWipe PC software product(s) was designed [e.g. Windows 2000, Windows 2003, Windows XP, Windows ME, Windows Vista and Windows 7]. (b) Backup Copies. You may NOT make copies of the AutoWipe PC software product(s); the software will remain available online from Wipe-My-PC.COM for the duration of the licence period you have purchased from Wipe-My-PC.COM or its affiliates.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. (a) Maintenance of Copyright Notices. You must not remove or alter any copyright notices on any and all copies of the AutoWipe PC software product(s). (b) Distribution. You may not distribute registered copies of the AutoWipe PC software product(s) to third parties. Evaluation versions available for download from Wipe-My-PC.COM’s website may be freely distributed if made available. No guarantee is implied or inferred on the basis of a trial version being made available in the future. (c) Prohibition on Reverse Engineering, De-compilation, and Dis-assembly. You may not reverse engineer, decompile, or disassemble the AutoWipe PC software product(s), except and only to the extent that such activity is expressly permitted by applicable law in the country that the work is undertaken not withstanding this limitation. This does not affect the license of any third party product(s) that may or may not be ‘bundled’ as part of the AutoWipe PC software product(s) either now or in the future; such third party items/software product(s) are subject to their own license(s) where applicable. (d) Rental. You may not rent, lease, or lend the AutoWipe PC software product(s). (e) Support Services. Wipe-My-PC.COM may provide you with support services related to the AutoWipe PC software product(s) (“Support Services”). Any supplemental software code provided to you as part of the Support Services shall be considered part of the AutoWipe PC software product(s) and subject to the terms and conditions of this EULA. (f) Compliance with Applicable Laws. You must comply with all applicable laws regarding use of the AutoWipe PC software product(s). You are bound by the laws of the country you reside.
3. TERMINATION Without prejudice to any other rights, Wipe-My-PC.COM may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the AutoWipe PC software product(s) in your possession. No refund will be given under such circumstances.
4. COPYRIGHT All title(s) including but not limited to copyrights, in and to the AutoWipe PC software product(s) and any copies thereof are owned by Wipe-My-PC.COM or its suppliers. All title(s) and intellectual property rights in the content which may be accessed through use of the AutoWipe PC software product(s) is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Wipe-My-PC.COM. Exceptions are granted where Wipe-My-PC.COM have made use of “Open Source” software or software from third parties that Wipe-My-PC.COM has no responsibility for. Open Source software or any third party software is subject to separate conditions available from their respective vendors or developers outlets. All registered trademarks not owned by Wipe-My-PC.COM and/or copyrights are the property of their respective owners.
This END-USER LICENSE AGREEMENT is a private agreement between the purchaser and Wipe-My-PC.COM and must not be reproduced in any form; such as published in print publications, posted, faxed, emailed or copied using any digital or non-digital method.
5. NO WARRANTIES Wipe-My-PC.COM expressly disclaims any warranty for the AutoWipe PC software product(s). The AutoWipe PC software product(s) is provided ‘As Is’ without any express or implied warranty of any kind, including but not limited to any warranties of merchantability, non-infringement, or fitness of a particular purpose. Wipe-My-PC.COM does not warrant or assume responsibility for the accuracy or completeness of any information, text, graphics, links or other items contained within the AutoWipe PC software product(s). Wipe-My-PC.COM makes no warranties respecting any harm that may be caused by the transmission of a computer virus or any other such computer program. Wipe-My-PC.COM further expressly disclaims any warranty or representation to Authorized Users or to any third party. Wipe-My-PC.COM provides software product(s)’s intended to help you wipe computers that you either own or have the responsibility for. All users of this software do so at their own risk, no penalty, blame or liability can be paced on Wipe-My-PC.COM, its owners or anyone related to its owners for the misuse, or accidental use of the software product(s). Because of the nature of the AutoWipe PC software product(s), users must accept that all use of the product is conducted entirely at the users own risk.
6. LIMITATION OF LIABILITY In no event shall Wipe-My-PC.COM and any of its representatives, owners or distributors be liable for any damages (including, without limitation, lost profits, business interruption, or lost information, including lost digital property and/or data) arising from use or inability to use the AutoWipe PC software product(s). Even if Wipe-My-PC.COM has been advised of the possibility of such damages. In no event will Wipe-My-PC.COM and any of its representatives, owners or distributors be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. Wipe-My-PC.COM and any of its representatives, owners or distributors shall have no liability with respect to the content of the AutoWipe PC software product(s) or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, and loss of privacy, moral rights or the disclosure of confidential information. All users of this software do so at their own risk.
7. PACKAGED SOFTWARE
Wipe-My-PC.COM may at any time make use of “Open Source” software product(s) under the terms of their respective products END-USER LICENSE AGREEMENT, licences or public licenses in whichever form they may take. Products used as part of the AutoWipe PC software product(s) are the property of their respective owners and are used lawfully in accordance with any END-USER LICENSE AGREEMENT, licences or public licenses in whichever form they may take. 8. Credits
Wipe-My-PC.COM currently contains (at time of writing) the components listed below that are licensed outside of this END-USER LICENSE AGREEMENT and are bound by their own respective software product(s) END-USER LICENSE AGREEMENT(s), licences or public licenses in whichever form they may take. Wipe-My-PC.COM makes use of these Open Source software product(s) ‘as-is’ and at no time makes changes to the products listed below:
A full and up to date list is exclusively maintained on the Wipe-My-PC.COM website only and is subject to change at any time at the discretion of Wipe-My-PC.COM.
9. Payments
Any payment(s) made to or through Wipe-My-PC.COM or its affiliates is at NO time accepted in return for Open Source software. All Payments made to or through Wipe-My-PC.COM are for “Support Services” and/or in return for the “Grant of License” to you the user(s), the conditions for which are laid out in section 1 of this END-USER LICENSE AGREEMENT.
10. Refunds
Due to the nature of the product refunds are not issued. Wipe-My-PC.COM cannot accept software returns as Wipe-My-PC.COM has no way of ensuring the software has not already been used prior to refund being issued. By accepting this agreement you are not forfeiting your statutory rights governed by the county in which the purchaser or eventual user resides.
