End-User License Agreement (EULA)

IMPORTANT--READ CAREFULLY
This is a legal agreement between you, the end user, and Apeaksoft Studio, the developer of the program ('Apeaksoft'), regarding your use of Apeaksoft products ('Software'). By installing the Software, you agree to be bound by the terms of this agreement.

SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The SOFTWARE PRODUCT is licensed, not sold.
1. GRANT OF LICENSE
This EULA grants you the following rights with respect to the SOFTWARE PRODUCT:
Once registered, you are granted a revocable, personal, non-exclusive and nontransferable license to install and activate the Software on only one computer for your personal and non-commercial use. You may not make the Software available on a network, or in any way provide the Software to multiple users, unless you have first purchased at least a MULTI-USER license from Apeaksoft Studio.
2. COPYRIGHT
All title and copyrights in and to the SOFTWARE PRODUCT (including but not limited to any images, photographs, animations, video, audio, music, and text incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by Apeaksoft Studio or its suppliers. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material, and may not remove or conceal any proprietary notices, labels or marks from the Software.
3. RESTRICTIONS
You may not, and you may not permit others to (a) reverse engineer, decompile, decode, decrypt, disassemble, or in any way derive source code from the object code portions of the SOFTWARE PRODUCT, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation; (b) modify, distribute, or create derivative works of the SOFTWARE PRODUCT; (c) copy (other than one back-up copy), distribute, publicly display, transmit, sell, rent, lease or otherwise exploit the SOFTWARE PRODUCT.
4. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
- COVER CD.
The reproduction and distribution of Apeaksoft Studio (evaluation copy only) in various Cover CDs published by associated magazines are allowed. However a copy of magazine with CD is required to be sent to Apeaksoft Studio.
- TERM
This License is effective until terminated. You may terminate it at any time by destroying the SOFTWARE PRODUCT, together with all copies thereof. This License will also terminate if you fail to comply with any term or condition of this Agreement. Upon such termination, you agree to destroy the SOFTWARE PRODUCT, together with all copies thereof.

LIMITED WARRANTY
NO WARRANTIES
Apeaksoft Studio expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is provided 'as is' without warranty of any kind, either express or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non-infringement. The entire risk arising out of use or performance of the SOFTWARE PRODUCT remains with you.
SEVERABILITY
In the event that any provision of this Agreement is declared invalid or void by statute or judicial decision, the parties agree that all other provisions not declared invalid or void shall remain in full force and effect.

NO LIABILITY FOR DAMAGES
In no event shall Apeaksoft Studio or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this Apeaksoft product, even if Apeaksoft Studio has been advised of the possibility of such damages.
MISCELLANEOUS
1. Apeaksoft Studio does not allow you to utilize our SOFTWARE PRODUCT to do anything that violates the local law. If you utilize our SOFTWARE PRODUCT to do the illegal activity, the consequent result shall be on your own responsibility. If you disagree with this item, please don't install and/or use the SOFTWARE PRODUCT.
2. The final interpretation is left to our discretion. Should you have any questions concerning this EULA, or if you desire to contact Apeaksoft Studio for any reason, please write to support@apeaksoft.com.

DISCLAIMER
After scanning device (including but not limited to iPhone) with the SOFTWARE PRODUCT, the device will reboot to Normal Mode. If the device reboots to Recovery Mode, users can click “Restart” button on the interface of the SOFTWARE PRODUCT to reboot to Normal Mode automatically.
Apeaksoft Studio will spare no effort to minimize the occurrence of this situation, but Apeaksoft Studio will not assume any loss for users.

PRIVACY STATEMENT
Please note and agree as follows: 'users privacy' is defined as User Name, Address, Phone Number and personal information, while privacy excludes the personal information (includes but not limits objective data generates from using and improving App).
Apeaksoft Studio respects and protects users privacy, and will not share, sell, use or disclose your personal information to any third-parties, unless your written agreement under related law and regulation.
Under the following conditions, Apeaksoft Studio will disclose users' personal information based on the user's will or the laws. Users themselves will be responsible for the resulting problems.
1. Obtain user's prior authorization;
2. Reveal the user's personal information to offer products and services requested by the user;
3. According to relevant laws, regulations or requirements of the relevant government agencies;
4. To protect Apeaksoft Studio Legitimate rights and interests;
5. The user violates the provisions of Apeaksoft Studio Terms of Service or any other products and services of use;
Adolescents may not use the services provided by Apeaksoft Studio to browse the content of any illegal, obscene, pornographic and other violations of public order and morals.

OTHER TERMS
Apeaksoft Studio holds right to modify this agreement without notification, according to the change of related law, regulation and business strategy. The modified version will be released on our site. If you disagree with any terms in this agreement, please terminate to use the SOFTWARE PRODUCT; your continued use is deemed to accept this agreement.
Apeaksoft Studio has the power to make the final interpretation and revision of this agreement to the maximum extent permitted by law.
