IMPORTANT
This Software End User License Agreement ('EULA') is a legal agreement between you and Monkfish XML Software ('Monkfish'). Read it carefully before completing the installation process and using XMLBlueprint ('Software').

By installing and using this Software, you agree to all the terms and conditions of this license. If you do not agree with the terms of this license, do not continue this installation or otherwise use the Software.

COPYRIGHT
This Software product is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All title and copyrights in and to the Software product (including but not limited to any programs, images, text, or documentation incorporated into the Software) are owned by Monkfish. Purchase of this license does not transfer any right, title or interest in the Software to you except as specifically set forth in this agreement. Except as permitted by such license, no part of the accompanying documentation may be reproduced, stored in a retrieval system, or transmitted, in any form or by any means, electronic, mechanical, recording, or otherwise, without the prior written permission of Monkfish.

LICENSE GRANT
Trial Period License -- You may download and use the Software for free for fifteen (15) days after installation ('Trial Period'). The evaluation copy of the Software will automatically disable the Software at the end of Trial Period. Monkfish will have no liability to you if the Software is disabled.

Professional License -- Specific individuals are authorized to use the Software and the total number of users may not exceed the total number licensed to you. You may install and use the Software on a maximum of three (3) computers per license.

Professional Floating License -- You may install the Software on an unlimited number of computers and use the Software by no more than the authorized number of concurrent user.

Home License -- This license may not be used in any commercial or revenue-generating business activities, including without limitation, work-from-home, teleworking, telecommuting, or other work-related use of the Software. You may install the Software on a maximum of three (3) computers, buy you may only run the Software on one (1) computer at a time.

Academic License -- The Academic License is available for educational and non-commercial purposes only.

LICENSE RESTRICTIONS
You may not provide or make available by any means the License Key to any third party.

You may not reverse engineer, disassemble, or decompile the Software. This Software is licensed as a single product and its components may not be separated for use on more than one computer. You may not modify, amend, adapt, translate, or create any derivative works based on, the Software or the provided documentation.

LIMITED WARRANTY
The Software is provided on an 'as is' basis, except as expressly set forth above, Monkfish makes no warranty of any kind, express or implied, including without limitation any implied warranty or merchantability or fitness for a particular purpose. Without limitation, you assume sole responsibility for selecting the Software to achieve your intended results and for the installation, use and results obtained from the Software. Monkfish makes no warranty that the Software will be error free or free from interruptions or other failures. In particular, the Software is not designed for use in hazardous environments requiring fail-safe performance. Monkfish expressly disclaims any warranty of fitness for high-risk activities.

Monkfish warrants to you (and only you) that the Software will perform substantially in accordance with the accompanying documentation (if any) for a period of ninety (90) days from the date of original purchase from an authorized retailer or directly from Monkfish.

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall Monkfish or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, damage to equipment, or other pecuniary loss) arising out of the use of or inability to use the Software, even if Monkfish has been advised of the possibility of such damages. This limited warranty gives you specific legal rights.

In any case, Monkfish's entire liability under any provision of this agreement shall be limited to the amount actually paid for the Software.
No other warranties: to the maximum extent permitted by applicable law, Monkfish disclaims all other warranties, either express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement and/or accuracy of information, with regard to the Software, and the provision of or failure to provide support services.

GENERAL
Monkfish makes efforts to provide updates or new versions of the Software, but Monkfish reserves the right at any time not to release updates or new versions of the Software or, if released, to alter prices, features, specifications, capabilities, functions, licensing terms, release dates, general availability or other characteristics of the Software.

This Agreement is governed by the laws of the Netherlands.

This Agreement constitutes the entire agreement between Monkfish and you related to the Software and supersedes any and all previous and contemporaneous understandings or agreements between the parties with respect to the same subject matter.
