This End-user License Agreement (EULA) is a legal agreement between you (either individual or single entity) and Gertscher Creactive Media. By installing, copying, or otherwise using the Licensed Product, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, promptly destroy the software media for a full refund.

Grant of License: This EULA grants you the following rights:

(a) You may use the Licensed Product on a single computer.

(b) This product will not track and collect confidential information about personal and business activities of licensees.

Restrictions on use: This EULA requires that you abide by these use restrictions:

(1) No Redistribution of Licensed Product. You may not separately publish, market, distribute, sell or sublicense, for fee or no fee, the Licensed Product or any part thereof without express consent from Gertscher Creactive Media in written form.

(2) Transfer of License. You may permanently transfer all of your rights under this EULA, provided you retain no copies, you transfer all of the Licensed Product including product data, associated media, and all documentation materials in printed, electronic or any other form, this EULA, and the recipient agrees to the terms of this EULA.

(3) Termination of License. Gertscher Creactive Media reserves the right to terminate this EULA at any time if you fail to comply with the terms and conditions of this EULA and offer you a full refund of registration cost. In such event, you must destroy all copies of the Licensed Product including product data, associated media, and all documentation materials in printed, electronic or any other form.

(4) Gertscher Creactive Media is licensed, by Code-it Solutions to license/ distribute this software under his own brand.

INFRINGEMENT WARRANTY: Gertscher Creactive Media warrants to you that, to the best of it's knowledge, the digital data comprising the Licensed Product do not infringe the rights, including copyrights, trade names, and intellectual property, of any third party.

LIMITATION OF LIABILITY AND WARRANTIES: Gertscher Creactive Media warrants that:

(a) the Licensed Product will perform substantially as described in the materials physically accompanying the delivery of the Licensed Product and within the software product page residing on Gertscher Creactive Media´s web site at www.stockaudiomaster.com, for a period of thirty (30) days from the date of receipt.

(b) if the Licensed Product is delivered:

(1) on physical media, the media will be free of defects for a period of thirty (30) days from the date of receipt, OR

(2) via electronic network, the received data will be free of defects for a period of thirty (30) days from the date of receipt.

Provided that you notify Gertscher Creactive Media within the 30-day warranty period, Gertscher Creactive Media's entire liability and your exclusive remedy shall be, at Gertscher Creactive Media’s option, either:
(a) refund of the price paid in exchange for return of the Licensed Product and destruction of all copies of the Licensed Product including product data, associated media, and all documentation materials in printed, electronic or any other form, or
(b) correction or replacement of the Licensed Product.
Some jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you.

No other warranties: To the maximum extent permitted by applicable law, Gertscher Creactive Media disclaims all other warranties either express or implied. You assume the entire cost of any damage, losses or expense resulting from your use or exploitation of the licensed product. You assume all responsibilities for selection of the licensed product to achieve your intended results, and for the installation of, use of, and results obtained from the licensed product. This limited warranty gives you specific legal rights. You may have others, which vary from jurisdiction to jurisdiction.

No liability for consequential damages: Common sense dictates that any software program be thoroughly tested with non-critical data before relying on it. While every precaution was taken to produce bug free code, you use this software at your own risk. Gertscher Creactive Media will not be liable for data loss, damages, loss of profits or any other kind of loss while using or mis-using this software. We pledge that Gertscher Creactive Media will never make available any software that has known defects that may result in damage of data residing on the system. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

This EULA is governed by the laws of the State of Wyoming, USA where the software was created.

This EULA constitutes the entire agreement between you, Gertscher Creactive Media with respect to the Licensed Product and supersedes any other communications or advertising, whether written or oral, with respect thereto. This EULA may not be modified or expanded except in writing signed by an authorized representative of Gertscher Creactive Media. If any provision of this EULA is held invalid or unenforceable, the remainder shall continue in full force and effect.
