1. COPYRIGHT.
All copyrights to SOFTWARE are exclusively owned by the author - MLM International (OWNER). Your license confers no title or ownership of the SOFTWARE and should not be construed as a sale of any right in the SOFTWARE.
You may not reverse engineer, de-compile or disassemble the SOFTWARE. MLM International shall retain title and all ownership rights to the SOFTWARE. You are not permitted to distribute the software for profit.
2. GRANT OF LICENSE.
The Registered SOFTWARE has no restricted features or limitations. The Registered SOFTWARE may be installed and used by unlimited users, but only one license should be installed on 'main' computer. OWNER will provide 2 different setup files, one for 'main' computer and one for all others. Only differences are setting up screen procedure which appears on the 'main' version + activating of the software. You must not give away your registration code. Doing so will result in an infringement of copyright. Your license gives you the right to receive email technical support and use other features available for registered users.
3. MONEY BACK AND PAYMENT OF SOFTWARE.
Customer can ask for money back if he just purchased the software “as is” and if software author did not made any changes based on customer instructions, like programming of custom compensation plans, uploading of software, restoring databse etc. If customer want to cancel the project after the software author made changes on software based on customer instructions, or software author made any other type of work, customer needs to pay real spend time of hours (hourly rate is priced $40). With other words, payment of first installment means that Customer accepted to pay the software in full and if he want to cancel the project and ask for money back, it is only possible if software author did not made any changes on software and spend no time to prepare the software for Customers usage. Otherwise, Customer can cancel the project but need to pay working hours based on Customers instructions and agreed steps. If author of software spend less time then paid amount, software author will return money in that amount what is difference between paid amount and spend time amount (hours * $40). Otherwise, Customer need to pay the difference between spend hours and paid amount and then he can cancel the project.
If the Customer will not cancel project but will not pay the software (or can not) in full, this license is not valid and Customer agree that software database will be uninstalled and software will not be functional until the license is paid in full for agreed amount. Paid amount will be keept by software author and will not be returned back to Customer.
4. DISCLAIMER OF WARRANTY.
THE SOFTWARE IS PROVIDED AS IS WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MLM INTERNATIONAL FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF THE USE OR PERFORMANCE OF THE PRODUCT AND DOCUMENTATION REMAINS WITH RECIPIENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MLM INTERNATIONAL BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF MLM INTERNATIONAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
