AdMaster End-User License Agreement
IMPORTANT – PLEASE READ CAREFULLY: This End-user License Agreement (“EULA”) applies to you and Media Masters d.o.o. Zrenjanin, Serbia, registration number 20826266 (hereafter called “Media Masters”), for the licensing and use of the software product named AdMaster, which includes the AdMaster software and all versions, features, applications and modules (hereafter called “Software” or “AdMaster”). This EULA also covers any associated media, printed materials and electronic documentation that we make available to you (with our Software).
BY CLICKING “ACCEPT”, DOWNLOADING OR OTHERWISE USING OUR SOFTWARE, YOU AGREE TO ALL TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO ANY OF THE TERMS OF THIS EULA, PLEASE IMMEDIATELY RETURN, DELETE OR DESTROY ALL COPIES OF OUR SOFTWARE IN YOUR POSSESSION.

1. The rights to use AdMasters are licensed, not sold. Media Masters hereby grants you a license to use the AdMaster during the license term that is indicated on your invoice. You may install use, access, display and run one copy of AdMaster on a single computer, such as workstation, terminal or other device. AdMaster may not be installed on more than one single computer (or workstation, terminal or other device) at the same time.
The license rights granted under this EULA are limited to the first 30 (thirty) days after you first install the AdMaster, unless you provide the internet connection that would allow AdMaster to automatically activate or reactivate your licensed copy in the manner described during the setup sequence of AdMaster. You might need to pass the activation/reactivation process again, if you change one or more hardware components of your computer, or the AdMaster itself. The Software contains the technological procedures that are designed to prevent unlicensed or illegal use; you agree that Media Masters may use those procedures without any limitations. Media Masters would not be held liable for any negative consequences of these procedures for you or your business.
You are allowed to create a backup copy of AdMaster, on a storage device such as USB Flash Memory, Online Backup or the External Hard Drive, but you must purchase the separate licenses for any separate computer/workstation used for installing, use, access display and/or run AdMaster. A single licensed copy of AdMaster must not be shared, or used on more than one computer/workstation, and/or used for processing data used on more than one computer/workstation.
2. ADDITIONAL SOFTWARE AND/OR SERVICES: This EULA is also valid for all upgrades, updates and/or online services related to the Software you would obtain from Media Masters, once you purchase the first AdMaster license, except if stated differently within the upgrade, update or online service. Media Masters reserves the right to stop any of online services provided by using AdMaster.
3. TRANSFER: You may move AdMaster to a different computer/workstation. This kind of transfer will require the new online activation/reactivation process. After the transfer of AdMaster to another computer, you must completely remove AdMaster from the former computer/workstation. The transfer of AdMaster to Third Party is not allowed, incluiding renting, leasing, lending or providing commercial access to third parties with AdMaster.
4. LIMITATIONS ON REVERSE ENGINEERING, DECOMPILATION AND DISASSEMBLY: AdMaster includes some elements (e.g. logic, algorithmics, codes) that we maintain as confidental information; it is a trade secret of and proprietary to us, our suppliers or licensors, including the specific internal design and structure of individual programs and associated interface information. You must maintain AdMaster in confidence, and prevent disclosure of its confidental aspects. You may not reverse engineer, decompile or disassemble AdMaster, excpt and only to the extent that it is expressly permitted by applicable law notwithstanding this limitation.
5. TERMINATION: Without prejudice to any other rights, Media Masters may cancel this EULA if you do not abide by the terms and conditions of this EULA, in which case you must destroy all copies of the Product and all of its component parts immediately. Important: Sections 3 and 4 of this EULA remain enforceable after termination.
6. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS: AdMaster containts components that enable and faciliate the use of internet-based server managed by Media Masters. You agree that Media Masters may automatically check the AdMaster version and/or its components you are using, and automatically disable the use an illegal or unlicensed copy of AdMaster without prior notice.
Media Masters and you will comply with the provisions of applicable data protection laws. Media Masters takes the protection of your personal and business data very seriously, and strictly abides by the data protection laws that apply to it. Your data will not be shared with third parties with your prior consent. Non-personal or anonymous data may be collected automatically to improve functionality and your experience with AdMaster, in particular to faciliate and improve the provision of software updates, support, content and other services. You agree that any non-personal or anonymous data collected may be send to our affilates for processing.
7. LICENSE FEES AND TAXES: You agree to maintain all applicable license fees listed within the offer you have accepted under payment terms. Fees do not include sales, use, value added or other taxes (including applicable withoulding taxes), all of which are your responsibility. Bank and credit card charges are also your responsibility and expense. All fees are payable in the currency included on our online order form.
Your right to use AdMaster ends immediately upon expiration of the license term purchased and stated on your last invoice.
8. WARRANTY: You expressly acknowledge and agree that use of AdMaster is at your sole risk, and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, AdMaster and any services performed or provided by AdMaster are provided “as is” and “as available”, with all faults and without warranty of any kind. We do not guarantee that the specifications or functions contained in AdMaster will meet your requirements, that the operation of our product will be uninterrupted or error-free, or that defects in our product will be corrected. We do not guarantee that AdMaster will work woth third-party software, or other products. We are not responsible for any kind of data loss, and/or your failures to make backup copies. Furthermore, we do not guarantee that AdMaster will continue to be available thorugh third-party online stores or markets, or for specific devices or systems manufactured by third parties.
9. LIMITATION OF LIABILITY: To the extent not prohibited by law, in no event shall Media Masters be liebla for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of, or related to your use or inability to use AdMaster, however caused, regardless of the theory of liability (contract, tort or otherwise), and even if Media Master has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall Media Master’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of EUR 10.
10. MISCELLANEOUS: In the event this EULA or any part thereof is found illegal, invalid or unenforceable, the parties shall agree on a provision that best reflects the respective clause that is legal, valid and enforceable.
Nothing in this EULA, express or implied, is intented to infringe on the legal rights of any other person or entity.
11. COPYRIGHT: AdMaster is protected by copyright and other intellectual property laws and treaties.
